These Terms of Use (“Terms”) govern your access to and use of Worktap.ca (“Worktap”, “the site”, “we”, “us”). By using Worktap, you agree to these Terms. If you do not agree, do not use the site.
Worktap provides an online job board focused on trades, hospitality, transport, fitness, and related roles in the Greater Toronto Area and Canada as described on the site. We publish employer-submitted listings after review where indicated. Worktap is not an employer, recruiter, or staffing agency unless expressly stated elsewhere.
You may browse listings and use features we make available (such as subscribing to updates or contacting us) in line with these Terms and applicable law. You agree not to misuse Worktap—for example by scraping the site in a way that degrades service, attempting unauthorized access, posting fraudulent listings, harvesting personal data from listings for unrelated marketing, or interfering with other users’ use of the site.
We may suspend or terminate access where we reasonably believe these Terms or the law have been violated.
Employers and anyone posting a job are solely responsible for the accuracy, legality, and fairness of their listings and for compliance with employment standards, human rights, occupational health and safety, immigration, advertising, and other laws that apply to them. Worktap does not verify every factual claim in a listing and review before publication is not an endorsement.
Listings must describe genuine roles. Postings that are deceptive, discriminatory (except where a permitted occupational requirement exists under law), unsafe, illegal, or unrelated to legitimate hiring may be removed or rejected without notice.
Job seekers use employer-provided apply instructions at their own risk. Worktap does not operate application pipelines or employer inboxes unless expressly stated. Your relationship with any employer is directly between you and that employer.
By providing an email address (for example when subscribing to alerts, posting a job, or using our contact form), you consent to Worktap and our service providers sending you operational messages related to Worktap—such as confirmations, listing status updates, or replies to your inquiry—in accordance with our Privacy Policy.
Marketing messages, where sent, will include a way to unsubscribe or opt out as described in our Privacy Policy.
Content on Worktap (excluding employer-provided listing text and similar user submissions) is owned by Worktap or its licensors. You may not copy, modify, or redistribute site materials except as allowed by law or with our written permission.
Worktap is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties and conditions—whether express, implied, or statutory—including merchantability, fitness for a particular purpose, quiet enjoyment, accuracy of listings, and non-infringement. We do not warrant uninterrupted or error-free operation.
To the fullest extent permitted by applicable law, Worktap and its operators, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business opportunities, arising out of or related to your use of Worktap—even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, our aggregate liability arising out of or relating to these Terms or the site will be limited to the greater of fifty Canadian dollars (CAD $50) or the amounts you paid Worktap directly for use of paid features in the twelve (12) months before the claim (if any such fees applied).
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum permitted by law.
You agree to indemnify and hold harmless Worktap and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your listings, your applications or contacts with employers, your breach of these Terms, or your violation of applicable law—except to the extent caused by our wilful misconduct.
We may update these Terms from time to time. We will indicate changes by updating the “Last updated” date. Continued use after changes constitutes acceptance of the revised Terms where permitted by law.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree that the courts located in Toronto, Ontario have exclusive jurisdiction over disputes arising out of or relating to these Terms or Worktap, subject to any mandatory consumer protections where you reside.
